Updated Guidance Relative to the Changes of the Open Meeting Law Under the Governor’s Executive Order

Governor's Order on Open Meeting Law Adjustments

Effective immediately, all non-essential meetings should be canceled as we have a limited number of conference lines. This procedure will be in place until further notice. Meeting via teleconference will be challenging and the added procedure on posting, voting, and timely recordings may seem unnecessary however we must try to be as transparent as possible even during a time that prohibits group gatherings. It is also important that all Committees and Boards follow the same procedure to avoid confusion to the public.

1. Fill out the Committee and Board Public Meeting Notice Form attached
2. Email Form to Diane Dunfee - ddunfee@nahant.org
1. Submit 48 hours prior to the start of the meeting
2. Submit notices no later than 30 minutes prior to the end of the Town Hall business day.
3. Carol will email you and webmaster back, the final public notice with added conference call details and the Chair’s email address on it.
1. Webmaster will be copied to this email notifying him to post the attached agenda onto our Town website and community calendar
2. Residents will then be able to locate a Board or Committee’s public notice by clicking on the community calendar item. The notice will include the conference dial-in instructions as well as the Chair’s email address.
4. The Chair will need to control the conversation on  the conference call.
1. When the sound for someone joining the conference call is prompted, the Chair should ask “whoever just joined us, please announce yourself”
2. The Chair should wait until a quorum of the Committee or Board has joined the conference call to begin the meeting
3. The Chair should start the meeting (and remind the participants throughout the meeting) by announcing the following guidelines:

1. All motions, seconds, and votes should be completed by roll call.

1. The Chair should control the vote by restating who made the motion, who seconded the motion, and then roll call the votes by reading off the committee members participating in the call and having them announce their vote when called upon.

1. All non-members of the Board or Committee participating in the call should be on mute. If they wish to ask a question or participate in the conversation, they should email the Chair during said meeting. The Chair should be monitoring his or her email for inquiries throughout the meeting. It is the discretion of the Chair to acknowledge non-members of the Board or Committee.
2. In a Public Hearing, the non-members of the Board or Committee that are participating in the hearing as part of a regulatory proceeding should not be required to be on mute and should be able to participate in said Hearing.

5. Minutes of Board and Committee meetings and hearings need to be approved and submitted to the Town Clerk in a timely fashion and according to the Open Meeting Law.

Steps To Use This Form:
1) Download the form and save it to your desktop
2) Fill Out The Meeting Notice Form Completely using Adobe Acrobat Reader
3) Save The Form And Change The File Name using this naming convention:
Example: Nahant School Committee sc_jan_01_2021_7pm (See Naming Table Below)
4) Email Saved Form to the Clerk or Print and bring it to the Clerk for posting

Pursuant to MGL chapter 30A, S 18-25 | All meeting notices and agenda's must be be filed with the Town Clerk and date stamped as such. All postings must be posted at least 48 hours prior to the scheduled meeting.

Completed Meeting Notice Forms must be delivered or emailed to the Town Clerk to be posted outside on the official posting bulletin board as well as in the Town Hall during Town Hall hours. All cancellations or location changes must be noted with the Town Clerk before the scheduled meeting.

Town of Nahant Meeting Notice File Naming Instructions

All Town of Nahant meeting notices and meeting minute files are properly named before they are posted on the Town’s website. Our current naming scheme has been in place for several years and is simple, strait forward easy to use once you start using it.

Please name all your meeting notices and meeting minutes documents before submitting them to the Town Clerk’s office for website posting. You may copy your particular board or committee meeting info below and reuse it over and over simply changing the (3) letter month, your (2) digit day, (4) digit year and meeting time (am or pm) each separated by a single underscore. All text is lower case, there are no commas, colons or other punctuation required except for the (4) underscores and the usual dot (.doc or .docx) after the file name.

If your board or committee is not on this list simply follow this scheme: (2 or 3 letter) abbreviation _mon_day_year_timepm.doc.  For meeting minutes just change the time to minutes.
